1. Moderne terms and conditions


These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions, you may not use or access this Website.

Before you place an order, if you have any questions relating to these terms and conditions, please contact our us by e-mail at info@modernebrighton.com 7 days a week.


 3. Use of the website

3.1 Registration

You warrant that:

(i)The Personal Information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects; and

(ii)You will notify us immediately of any changes to the Personal Information by contacting us by e-mail.

(iii)You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.



 3.2 Indemnity


You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.


3.3 Our rights


We reserve the right to:

(i)modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or

(ii)change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.



 4. Privacy


We will treat all your Personal Information as confidential (although we reserve the right to disclose this information in the circumstances set out below). We will keep it on a secure server and we will fully comply with all applicable UK Data Protection and consumer legislation from time to time in place.

When you shop on this Website, we will ask you to input and will collect Personal Information from you such as your name, e-mail address, billing address, delivery address, telephone number, product selections, credit card or other payment information and a password.

We may also collect information about where you are on the internet (e.g the URL you came from, IP address, domain types like .co.uk and .com), your browser type, the country and telephone area code where your computer is located, the pages of our website that were viewed during your visit, the advertisements you clicked on, and any search terms that you entered on our website ("User Information").

We may collect this information even if you do not register with us.

We confirm that any Personal Information which you provide to us is used only for the following purposes of processing your orders.

 5. Products


We endeavour to describe all items as fully as possible, to the best of our knowledge, providing as much history, age and detail as is known to us together with a full description of any discernible defects or faults.

Items are antique or vintage items, which may in some cases, have some age-related wear. Items that are manufactured some time ago often have marks, dents, variations of surface texture, re-polished surfaces, minor scratches or losses, sympathetic replacements, retouching, relining, and other issues naturally associated with use and age which form a part of the appearance and nature of a vintage item.

We aim to ensure that the condition of any item is as reasonable as possible given its age and nature, and would not offer for sale any item that is not substantially complete or in a minimum acceptable condition for display or use.

Substantial damage or extensive restoration or changes or losses to the item beyond this will be stated in our item descriptions.

Small signs of wear are normal and appropriate to the authenticity of vintage products. By placing an order, you are deemed to acknowledge the vintage nature of the products we are selling.

We will take all reasonable steps to pack the products properly and to ensure that you receive your order in good condition.

We shall not be liable for any defect in the products arising from wear and tear, wilful damage, accident and/or negligence by you or any third party, if you use the products in a way that we or the manufacturers do not recommend, you fail to follow the manufacturer’s and/or our instructions, or due to any alteration or repair you carry out without our prior written approval.

The products we sell are authentic, original products, which were manufactured before today's stringent health and safety standards.

We do not guarantee or imply any guarantee of compliance with health and safety standards or fitness for any purpose. All original vintage products are clearly marked as such in the product description with a date or approximate date of manufacture.

All our electrical products are inspected, tested, certified by a qualified electrician and while products may be perfectly safe for use, we do recommend (before installation) you personally carry out your own inspection by a certified electrician. We also recommend that vintage electrical products are protected by a residual current device (RCD) device.

We will not be liable for any loss, injury or death caused by electrical products that have not been inspected, tested and certified by a qualified electrician prior to installation in your premises.


 6. Deliveries

Moderne's deliveries are carried out via small third party delivery companies and as such we are unable to offer same day delivery or return delivery.

Once a delivery time has been arranged it is your responsibility to be in, if you miss the appointment or fail to inform us that you will be unable to receive the delivery it is with regret but you will be charged for the missed delivery appointment and any subsequent attempts.

If you are unable to be in we require at minimum 24 hours notice or charges will apply.

Deliveries are for Mainland UK only excluding Ireland, The Isle of Wight and the Scottish Highlands.

Deliveries can take up to 21 working days and sometimes longer subject to weather conditions.



 6.1 Customer’s own arrangement


You are also more than welcome to arrange a courier yourself or to collect the product from us in person.

If you chose to contract your own courier then they will be responsible for the item once it has left our care and their insurance cover will become relevant to the delivery.

We will communicate with your choice of provider to arrange pick up times but reserve the right to dictate when we are available and it is convenient to us.

collections must be made within 7 days of purchase unless prior terms are agreed, after this storage charges will apply.

Payments will need to be made directly with third party couriers or shippers and you will need to communicate directly with them, once the products have left our premises.

For the avoidance of doubt, contracts are between you and the third party company and as such Moderne take no responsibility once the item has left our premises. We will however, always help where we can.

 7. Storage


For larger items we are able to offer a 7 day period of free storage while the item is being collected/delivered.

Please note that while items are stored in our warehouse during the 7 day period we will be responsible for them but after this if uncollected you leave them there at your own risk and we accept no liability.

Items not collected within the 7 day period will be stored at a cost of £20 per week. if you are unable to collect within the period of 7 days from purchase you must contact us within this time and we will see if we can help.



 8. Ordering and cancellations


 8.1 Orders


When you place an order with Moderne through Moderne's website you are agreeing to purchase the item and a legal contract to purchase is then formed to do so.

The steps required to create the contract between you and Moderne are as follows:

(i)You place the order for your products on the Website by pressing the confirm order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website

(ii) Moderne will send you an order acknowledgement email detailing the products you have ordered.

(iii)Order acceptance and the completion of the contract between you and Moderne will take place on the despatch to you of the Products ordered unless we have notified you that we do not accept your order.

You will not be charged and no payment taken upon ordering through the website.


 8.2 Non-acceptance of an order


Non-acceptance of an order may be a result of one of the following:

(i)The product you ordered being unavailable from stock

(ii)The identification of a pricing or product description error.


 8.3 Cancellations


We're sorry it's not possible to make changes to your order once you've placed it.

To add products to your order, please place a new order for these items.

To change details of your delivery address, remove items from your order or cancel it completely, please contact us within 24 hours at info@modernebrighton.com between 9am and 6pm, Monday to Saturday. Please be ready to quote your order number and order date.

It is not possible to cancel an order once it has been dispatched.

 9. Refund and returns policy


 9.1 Returning a product


We want you to be happy with your purchase and will always try to provide a solution but due to the unique and second hand nature or our pieces we can only accept returns if goods are not fit for purpose or have been grossly misdescribed at point of sale. As some items are bespoke, unique or difficult to restock we must look at each return on an individual basis.

You must contact us in writing within 14 days of purchase to inform us of any issues.

If the issue qualifies for a return you then have a further 7 days to return the item to us via a reliable insured courier.

The item must be returned unused and in the condition which it was sold in. We reserve the right to deduct the cost of any damage incurred to the item, cleaning which may be required or modifications and restoration made at the buyers request prior to purchase.


 9.2 Faulty and damaged goods


If goods are faulty we will firstly attempt to get the fault fixed and return the item to you and if we cannot then in most cases we will issue a credit note and on occasion we will issue a full refund.

We inspect all our products thoroughly but all goods are sold as seen due to their second hand nature and as such do not come with a manufactures guarantee.

All our vintage lamps are professionally rewired and come with a 12 month electrical guarantee, we do not accept liability for blown fuses or bulbs or damage to the lamp once an item has left the store.

In the unlikely event that there is an electric fault with your lamp then return it to the shop within the 12 month period along with proof of purchase and we will attempt to fix it and issue a refund if it cannot be fixed. Due to the unique nature of most of our lamps we cannot offer replacements.


 9.3 Sale items and items delivered by third parties


We will endeavour to list all faults and give as accurate a description of all items as we can but we regret that we cannot accept returns on items purchased in the clearance sale.

Freight items delivered via third party delivery services provided by Moderne must be checked thoroughly and approved by you when you take receipt of them and any problems notified to the driver at the time of delivery.

We will ask you to sign to say that you are happy with the condition of your items and that they are in a usable state and fit for purpose.

Items delivered by third party delivery services provided by you the customer will be the responsibility of your chosen delivery company and Moderne accepts no liability for any damaged caused in transit.
